Home Depot Clearance Centre (www.homedepotstores.co.za) owns and operates this Website. www.homedepotstores.co.za will further be referred to as the “Website”.  This document governs your relationship with www.homedepotstores.co.za . Access to and use of this Website and the products and services available through this website are subject to the following terms, conditions and notices. When placing an order online, a user profile is created which will serve as consent to acceptance of all the Terms & Conditions which may be updated by us from time to time. You should check this page on a regular basis to take note of any changes we may have made to our Terms & Conditions.

You are responsible for maintaining the confidentiality and security of your Username and Password for access to the Website and you accept full liability for all activities that occur on or related to the Website under your Username. You may not impersonate another user or any third party,  provide false information to gain access to the Website

Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or this entire Website.

Use of Website

Use of this Website is entirely at your own risk. You (the customer) may only use this Website for lawful purposes and you warrant that you will not, other than for your personal and non-commercial use, store on your computer, or print copies of extracts from the Website. Use of the information in any manner which infringes any copyright or proprietary interest of Home Depot Clearance Centre is prohibited.

You will not commit or encourage a criminal offense, transmit or distribute a virus, trojan, worm or any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive, hack into any aspect of the Website, corrupt data, cause annoyance to other users, infringe upon the rights of any other person’s proprietary rights, send any unsolicited advertising or promotional material, commonly referred to as “spam”, or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website. Breaching this provision would constitute a criminal offence and such offence will be reported to relevant Law Enforcement Authorities.

We will not be liable for any loss or damage caused by a distributed virus or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it. We will however take utmost precaution on our side to prevent this from happening but cannot guarantee as such.

Privacy

All private information required for executing the orders placed through the Website, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by our Provider and not sold or made known to a third party. Email addresses and telephone numbers will be used solely for the purpose of sending correspondence regarding your order or promotional offers. Only necessary information namely delivery addresses and contact numbers will be made known to the third party, which will be the courier.

The Provider cannot be held responsible for security breaches occurring on the User’s electronic device (cell phone, tablet, laptop etc.), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.

Information regarding the operating systems, browsers and IP origins of the users of this website is collected for statistical reporting purposes. No personal information regarding the users of this website is obtained aside from that which is freely given by the user.

Placing of Orders and Terms of Sale

In order to contract with www.homedepotstores.co.za you must be over 18 years of age. www.homedepotstores.co.za retains the right to refuse any requests made by you. We could at any stage of your transaction request confirmation of your identity by requesting a copy of your ID document and a copy of the front of your credit card. If your order is accepted we will inform you via email.

When placing your order you undertake that all details your  provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of local and foreign goods may fluctuate. All prices advertised are subject to such changes.

Orders placed may be declined or cancelled in the event of products being out of stock, damaged products, incorrect product information, incorrectly displayed or error in product pricing, and due to payment for product not being received or payments not authorised by Home Depot Clearance Centre.

Once you have selected your payment method, you will be directed to a link to a secure site for payment of the applicable purchase price of the goods.

Throughout the processing of your order you will be receiving updates via email as to the status of your order. If you have any queries you can contact us at any stage via email on website@homedepotstores.co.za .

Payment Methods

Your payment for any products ordered online from www.homedepotstores.co.za must be made to us in any one of the following ways.

·         Credit / Debit / Cheque Cards – where payment is made by credit card, we may require additional information in order to verify the validity of payment. In such cases we reserve the right to withhold delivery until such time as this additional information is required.

·         Direct Bank Deposit or Electronic Funds Transfer (EFT) – where payment is made by bank deposit or EFT you must pay the exact amount as stated on the order receipt, the payment must be identified by supplying the order number as a reference and proof of payment must be sent via email to website@homedepotstores.co.za  using your order number in the subject line of the email. Screenshots, copy of bank statements, etc. will not be accepted as valid proof of payment.

        We will not execute the order until receiving proof of payment via email and the money is reflecting in our bank account. Payment can take up to 3 working days to reflect in our bank account depending on the bank that you use and the availability of funds in your account.

Guarantees

All products are covered with at least a 1 year repair guarantee (unless specifically stated otherwise). Further guarantees may vary between products. Products are covered against manufacturing defects or faults only. No damages caused by wear and tear, negligence, abuse, not following care instructions, accident or causes unrelated to defective materials or workmanship are not covered by the guarantee. Repairs on defective products can take up to 21 working days from date when product is received back in our warehouse.

The fabric on all Lounge Suites, sofas and chairs are not covered under the guarantee.

Although Home Depot Clearance Centre administers the guarantees, all guarantees provided on products are Supplier Guarantees that are seeded to the customer. It is therefore not a Home Depot Clearance Centre Guarantee.

Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Although all product items are displayed on the website, this is no guarantee that there is stock available. Home Depot Clearance Centre will not be held liable for products displayed on the website that are out of stock. In the event of a product being out of stock, we will contact you and you will have the option to either cancel your order or to place your order on a back order until stock arrives (if the item is on order at that stage). If you decide to cancel your order, you will receive a full refund.

Delivery fees are excluded from the price indicated on the item.

Colours

We have done our best to display as accurately as possible the products shown on this website. However, the colours of our products shown on this website may look different on your computer screen compared to the colour of the actual product. This is because different computers display colours differently depending on the type of computer screen. We cannot guarantee that your monitor’s display of any colour will be accurate.

Delivery and Collections

Home Depot Clearance Centre offers two methods of delivery of goods namely delivery via courier or collection from one of our stores.

Additional delivery charges apply to all deliveries and is not included in the product price. Delivery charges will apply as follows :

·         Orders less than R5000 will add an additional R450 excl VAT to your checkout total

·         Orders more than R5000 will add an additional 12% of your total order before VAT to your checkout total.

We aim to deliver all orders between 5-14 working days but no later than 30 days from the receipt of payment. We will notify you if we are unable to deliver within the estimated delivery time. We shall not be liable for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.

When effecting delivery at the premises as nominated by you the customer, you will be responsible of receiving and checking the products in the presence of the 3rd party delivery services. We require that a delivery document be signed by the customer to indicate that each item has been received in good order. Home Depot Clearance Centre cannot be held liable for any damages that aren’t marked clearly on the delivery note.

Some of our products will be delivered unassembled and it is the responsibility of the customer to assemble the product according to the assembly instructions included with the product.

Deliveries will only be made where there is reasonable access. It is the customer’s responsibility to ensure that items can easily pass through doors, staircases, etc. No products will be hoisted up balconies or through windows. If customers request that these terms be ignored, Home Depot Clearance Centre will not be held liable for any damaged goods or personal property.

Returns and Refunds on Non-Damaged Goods

Home Depot Clearance Centre operates strictly according to the Consumer Protection Act.

If for any reason you wish to return product/s you may do so within 7 days of the products being delivered to you, provided the products have not been used, are complete, in their original condition and sealed in original packaging.

For products that are not defective, a handling fee of 10% will be applicable. This amount will be deducted off the refund amount.

In terms of section 44(2) of the Electronic Communications and Transactions Act 25 of 2002, for non-defective items, the customer will be liable for delivery and collection costs.

Home Depot Clearance Centre reserves the right to refuse the return of products that have been assembled, partly assembled, or where the original packaging has been discarded. If the original packaging has been discarded and the return has been approved, it will be the customer’s responsibility to ensure that goods are reasonably packaged and protected before being returned. Damages that occur could carry additional charges.

Once returned goods have been received in our warehouse, a quality inspection will be done. This quality control inspection can take up to 7 working days.

Once refund has been authorised an EFT payment will be made to the customer’s account. EFT refunds can take 3-5 working days to reflect in your bank account.
